Small Wind Energy Systems Ordinance

 

 

A.               Purpose:

 

This small wind energy systems ordinance is enacted in accordance with RSA 674:62-66, and the purposes outlined in RSA 672:1-III-a.  The purpose of this ordinance is to accommodate small wind energy systems in appropriate locations, while protecting the public’s health, safety and welfare.  In addition, this ordinance provides a permitting process for small wind energy systems to ensure compliance with the provisions of the requirements and standards established herein.

 

 

B.                Definitions:

 

Meteorological tower (met tower).  Includes the tower, base plate, anchors, guy wires and hardware, anemometers (wind speed indicators), wind direction vanes, booms to hold equipment for anemometers and vanes, data loggers, instrument wiring, and any telemetry devices that are used to monitor or transmit wind speed and wind flow characteristics over a period of time for either instantaneous wind information or to characterize the wind resource at a given location.  For the purpose of this ordinance, met towers shall refer only to those whose purpose are to analyze the environmental factors needed to assess the potential to install, construct or erect a small wind energy system.

 

Modification.  Any change to the small wind energy system that materially alters the size, type or location of the small wind energy system.  Like-kind replacements shall not be construed to be a modification.

 

Net metering.  The difference between the electricity supplied to a customer over the electric distribution system and the electricity generated by the customer’s small wind energy system that is fed back into the electric distribution system over a billing period.

 

Power grid.  The transmission system, managed by ISO New England, created to balance the supply and demand of electricity for consumers in New England.

 

Shadow flicker.  The visible flicker effect when rotating blades of the wind generator cast shadows on the ground and nearby structures causing a repeating pattern of light and shadow.

 

Small wind energy system.  A wind energy conversion system consisting of a wind generator, a tower, and associated control or conversion electronics, which has a rated capacity of 100 kilowatts or less and will be used primarily for onsite consumption.

 

 


 

System height.  The vertical distance

from ground level to the tip of the

wind generator blade when it is at

its highest point.

 

 

Tower.  The monopole, guyed monopole or lattice structure that supports a wind generator.

 

 


Tower height.  The height above grade

of the fixed portion of the tower,

excluding the wind generator.

 

 

 

Wind generator.  The blades and associated mechanical and electrical conversion components mounted on top of the tower whose purpose is to convert kinetic energy of the wind into rotational energy used to generate electricity.

 

 

C.               Procedure for Review:

 

1.                  All Building Permit Applications for the installation of small wind energy systems are subject to the Special Exception process.

 

2.                  Building Permit:  Small wind energy systems and met towers are an accessory use permitted in all zoning districts where structures of any sort are allowed.  No small wind energy system shall be erected, constructed, or installed without first receiving a Building Permit from the Zoning Officer.   A Building Permit shall be required for any physical modification to an existing small wind energy system.  Met towers that receive a Building Permit shall be permitted on a temporary basis not to exceed 3 years from the date the Building Permit was issued.

 

3.                  Application:  Building Permit Applications submitted to the Zoning Officer shall contain a site plan with the following information:

 

i)                    Property lines and physical dimensions of the applicant’s property.

 

ii)                   Location, dimensions, and types of existing major structures on the property.

 

iii)                 Location of the proposed small wind energy system, foundations, guy anchors and associated equipment.

 

iv)                 Tower and foundation design, with evidence of adequate structural design.

 

v)                  Setback requirements as outlined in this ordinance.

 

vi)                 The location of the right-of-way of any public road that is contiguous with the property.

 

vii)               The location of any overhead utility lines.

 

viii)              Small wind energy system specifications, including manufacturer, model, rotor diameter, tower height, tower type, nameplate generation capacity.

 

ix)                 Small wind energy systems that will be connected to the power grid shall include a copy of the application for interconnection with the electric utility provider.

 

x)                  Sound level analysis prepared by the wind generator manufacturer or qualified engineer.

 

xi)                 Electrical design to be reviewed and approved by a licensed New Hampshire electrician to allow for a determination that the manner of installation conforms to the NH State electric code.

 

xii)               List of abutters to the applicant’s property.

 

4.                  Abutter Notification:  In accordance with RSA 674:66, upon receipt of an application for a Building Permit to construct a small wind energy system, the Zoning Board of Adjustment shall notify all abutters, by certified mail, that a Building Permit Application has been received by the Zoning Officer, and that the public will be afforded 30 days to submit comments to the Zoning Board of Adjustment prior to the issuance of the building permit by the Zoning Officer. Concurrently, a completed Application for a Special Exception shall be submitted the Zoning Board of Adjustment, and notification of said Special Exception Application shall be made, as well, in accordance with RSA 674:33.

 

This Special Exception Application and all required information must be filed at least 21 days before the date of the meeting at which it is to be submitted to the Board. Article II Definitions

 

Apartment: A Dwelling Unit (changed from A dwelling unit which is the principal residential Building.)

 

Small Wind Energy System (a new definition): A wind energy conversion system consisting of a wind generator, a tower, and associated control or conversion electronics, which has a rated capacity of 100 kilowatts or less and will be used primarily for onsite consumption.

 

Article III Establishment of Districts and District Regulations

 

Section C Table of Permitted Uses (add in): Small Wind Energy System (See Small Wind Energy Systems Ordinance) (to be permitted by Special Exception (E) in all 3 districts)

 

 

Article IV General Provisions Applicable in All Districts

 

Section B Principal Residential Building 2: New wording  to read: 2. One detached Dwelling Unit, not exceeding seven hundred (700) square feet of living space may be permitted by Special Exception, on a lot of record of at least two (2) acres, which contains not more than one existing Dwelling Unit. Such Dwelling Units will be regulated as a Two Family Dwelling. If the primary dwelling is manufactured housing then the detached Dwelling Unit may not be manufactured housing.

 

Section I (create new section) SMALL WIND ENERGY SYSYTEMS ORDIANCNE This small wind energy systems ordinance was adopted on March 13, 2012, and is enacted in accordance with RSA 674:62-66, and the purposes outlined in RSA 672:1-III-a.  The purpose of this ordinance is to accommodate small wind energy systems in appropriate locations, while protecting the public’s health, safety and welfare.  In addition, this ordinance provides a permitting process for small wind energy systems to ensure compliance with the provisions of the requirements and standards established herein.

 

Article V Special Provisions

 

Section B Planned Residential Development (add in) APPENDIX OF THE SUBDIVISION REGULATIONS Attachment 11.  Planned Residential Development was adopted on December 14, 2009.

 

Article VII Administration and Enforcement

 

Section A  Permit Required f. (new section) The conversion of existing space to become a separate dwelling unit or apartment.

 

Section D Enforcement and Penalties (change amount to be incompliance with RSA 676:17) 2. Any person, firm, corporation or other entity who violates the provisions of this Ordinance shall be subject to a fine of not more than one hundred dollars ($275.00) for each offense. No action shall be brought under this provision unless and until the alleged offender has had at least fourteen (14) days written notice by certified mail that a violation exists. Each day a violation is continued shall constitute a separate offense.

Article 7:         To see if the Town will vote to raise and appropriate the sum of twenty seven thousand five hundred twenty four dollars ($27,524) to purchase a 2009 Ford Explorer for the Police Department and to authorize the withdrawal of eighteen thousand five hundred twenty four dollars ($18,524) from the Police Department Capital Reserve Fund established in 1992 for that purpose, and to further authorize the withdrawal of nine thousand dollars ($9,000) from current fund balance (surplus).

 

            Majority vote required.

            This article will result in no new taxation.

 

 

Article 8:         To see if the Town will vote to raise and appropriate the sum of five thousand dollars ($5,000) for the repair of stones and monuments in the Town Cemeteries.

This appropriation is in addition to Article 2, the operating budget.

 

 

Article 9:         To see if the Town will vote to raise and appropriate the sum of twelve thousand dollars ($12,000) for the Town’s Land Conservation Fund established in 1988 for the acquisition of land, easements, and development rights determined to be of significant environmental value to the Town. Under RSA 36-A amounts from this fund may be spent for these purposes without further town meeting approval, if approved by the Selectmen, and by the Conservation Commission, after holding a public hearing.

 

Majority vote required.

This appropriation is in addition to Article 2, the operating budget.

 

Article 10:      To see if the Town will vote to raise and appropriate the sum of up to forty five thousand ($45,000) to purchase a used, roll-off truck to haul transfer station materials, and to authorize the withdrawal of up to forty five thousand dollars ($45,000) from the Recycling Special Revenue Fund established in 2005 for that purpose.

 

                                    Majority vote required.

                                    This article will result in no new taxation.

 

 

Article 11:       To see whether the Town will vote to adopt Zoning Amendment No. 1, (pet crematoriums) as proposed by the Planning Board. A copy of the complete text of the proposal is on file and available for review at the Town Office.

Conservation Training Sessions

You are invited to participate in a new Land Conservation Training Program for community leaders in the Monadnock Region. This is a great opportunity to learn more about protecting land in your community from some of New Hampshire’s most knowledgeable conservation professionals.

This training is presented by the Community Conservation Partnership, a collaborative initiative of the Monadnock Conservancy, the Center for Land Conservation Assistance, Antioch New England Institute, and the Southwest Region Planning Commission. The goal of this initiative is to strengthen the land protection capacity of towns in the Monadnock Region.  

This training is one of several services being developed by CCP. It aims to prepare community leaders to work with land owners interested in protecting their property’s natural resource values, with local governments seeking ways to protect their town’s rural character and special places, and with land trusts.

The Training Program
This is a six-session training. The first five sessions will take place every other Wednesday from October 8 to December 3, 2008. Each session will be held in the Keene Public Library, Kay Fox Room from 6:00-9:00 pm. The topics covered in these five sessions will include:

·        common criteria used by land trusts and towns in selecting projects to support

·        how to talk to landowners about their land protection objectives and pull together documentation needed for land protection transactions

·        approaches tried by other towns participating in this training


Costs

This training is sponsored by funds raised through the Monadnock Tomorrow capital campaign and grants awarded to the Monadnock Conservancy by the Jessie B. Cox Charitable Lead Trust, the Northeast Utilities Foundation, and the New Hampshire Charitable Foundation. Thanks to our funders, for this first training, the CCP is offering the 2008 sessions free of charge. Participation in the January 31st session will require the $20 conference registration fee. Please note, our future training program may cost $100 per person or more, so sign up now!


Enrollment
This training is limited to 25 people, with priority given to representatives from our five CCP pilot towns – Alstead, Gilsum, Surry, Walpole, and Westmoreland. Participants from other towns will be accepted on a first come first served basis. We encourage each town to send at least two representatives to the training and will limit enrollment to four participants per town.

Qualifications for participation include:

1.      Strong interest in land conservation.

2.      Ability to attend at least 5 of the 6 training sessions

3.      Willingness to serve as a community conservation resource following the completion of the training.

4.      Ability to communicate effectively with a broad cross section of the community
